Ltd Guliani Group Georgia(hereinafter, the“Service Provider”) and customer, who registers order at website of mochi.ge and identifies himself/herself by entering his/her personal information (hereinafter, the“Recipient of Service”), are entering into a binding contract at the website of mochi.ge.In these terms and conditions, “we”, “us”, “our” or “Mochi” refers to Ltd Guliani Group Georgia, and “you” and “your” refers to you as the user of our website.

By using our website and registering your order, you confirm that you accept these terms and conditions and that you agree to comply with them.

1. Subject of the Agreement

1.1. Subject of this agreement is product presented on mochi.ge’s website and delivery service of this product at desired location, for which you shall pay prescribed sum of money

1.2. Mochi is entitled to modify the terms and conditions of this agreement for any reason at any time, by making an amendment on our website.

1.3. The Service Provider has no obligation to notify the Recipient of Service about changes of the terms and conditions of this Agreement.

2. Obligations of the Service Provider

2.1. The Service Provider shall take and carry out your order, if the sufficient supply is available.

2.2. After receiving the order, on average in a 0.5-1 hour time, the Service Provider shall deliver the product at agreed location.

2.3. The Service Provider shall protect customer’s personal data.

2.4. If the product is not delivered on behalf of Mochi, the Service Provider shall return funds to customer in 2 business days.

2.5. The service provider shall provide customers with high quality product, produced in proper sanitary and hygienic conditions.

3. Obligations of the Recipient of Service

3.1. The Recipient of Service shall provide Mochi with accurate personal data(name, surname, address, mobile phone number).

3.2. Accept ordered product in a timely manner from representative of Mochi.

3.3. Make cashless payment with their personal bank plastic card.

3.4. Carefully review ingredient list on the website and in case of being prone to severe allergic reactions, recheck thoroughly ingredient list with Mochi in order to prevent possible allergic reaction, in case of which customer holds full responsibility.

4. Payment and ordering terms

4.1. On the website mochi.ge you shall indicate whether you will use delivery service or take away product from Mochi at Paliashvili 65.

4.2. If you choose delivery service, you shall choose the district, which is included in Mochi’s delivery service area.

4.3. Choose desired product/products.Chosen product will automatically be added to the cart.If you have chosen delivery service, the fee of delivery service will be reflected in ‘Order Total’.

4.4. Complete the authorization or registration process(by Facebook account or mobile phone number). After this stage, system will take you to the “profile” page, where you shall check accuracy of the phone number and if the phone number is incorrect, you shall write in your active mobile number.

4.5. Return to the cart and click the button – “Choose Your Payment Method”. After clicking, you will be transferred to a payment page.

4.6. Choose the payment method, in case of cashless payment, make payment with your own debit/credit card, when paying in cash indicate what note you will have.

4.7. Filling in comment field is obligatory.You must indicate for how many persons is the product considered, you may also write down address details(e.g.password of lock of entrance door), notice concerning dish or any other information you consider necessary for carrying out your order.

4.8. Tick the box confirming that you agree with Terms and Conditions.

4.9. The message about your order confirmation will pop up.

4.10. The prices on the website include value added tax.

4.11. We do not hold responsibility for any other form of order, but for the procedure indicated above.

4.12. Refund by Mochi may only be made, in case of complete failure of delivery of the service.In case of inaccuracy of address, or cancelling the order post-factum, the customer will not receive the refund.Material refund shall only be made to the same bank account or shall be given to the same person, who ordered the product and made a payment.

5. Termination Clause

5.1. In case any of these terms contradicts the law, or new act of law is passed, given agreement shall remain in force.The Provider of Service holds responsibility to amend the relevant term in accordance with the law.

5.2. The titles indicated above do not hold any legal importance and are solely there to make content more comprehensive.

5.3. The terms of service indicated above extends to each and every customer equally.

6. Dispute Resolution

6.1. The terms and conditions prescribed herein shall be governed by, construed and interpreted in accordance with the laws of Georgia.The parties shall attempt to resolve any dispute or claim through negotiations.Should the parties fail to reach an amicable solution through negotiations, the courts of Georgia shall have a jurisdiction to settle any dispute or claim in accordance with the laws of Georgia.
